End-User License Agreement (EULA) & Terms of Use

This is a legally binding contract. By purchasing, downloading, or using any photographic image, background, or media asset (collectively, the "Asset" or "Assets") from Licensor, Licensee agrees to be bound by the terms of this End-User License Agreement.

Licensor:
Heaven & Nature Co. LLC operating in part under the brand name Nature Church Media ("Licensor")
Licensee:
The purchasing church, ministry, or other religious entity or person ("Licensee")
Purpose:
Background display for worship lyrics and other screen use in corporate church, ministry or nonprofit settings
Territory:
Physical premises of your church or organization. The Territory includes online participants in livestreamed services, provided the livestream originates from Licensee’s physical premises or an event hosted by Licensee at another location.
Other Restrictions:
Licensee shall not publish, display, distribute, broadcast, stream, or otherwise make available the Assets on the internet, including on Licensee’s website or social media channels outside of the Assets appearing as part of a recording of a service or event in the Territory.

IMPORTANT NOTICE: DIGITAL-ONLY USE

This License explicitly prohibits any form of physical print reproduction. If you do not agree to these terms, do not purchase or download the Assets.

1. Grant of License

Licensor is the author and owner of the Assets. Subject to the terms and conditions of this Agreement, Licensor grants Licensee a perpetual, royalty-free, non-exclusive, non-transferable, and worldwide license to copy, display, and internally distribute (defined below) the downloaded Assets for religious, ministry, nonprofit, and non-commercial services or events in the Territory.

2. Multi-Site & Central Ministry Usage

This License is issued to the purchasing organization as a single legal entity.

  • Multi-Campus Permission: This license explicitly extends to all physical campuses, satellite locations, and portable church plants operating under the same central ministry leadership, name, or legal entity. The license does not extend to denominational or church networks whose members include multiple distinct churches—in that case, each such church needs a separate license.
  • Internal Distribution: Central production, media, or tech teams are permitted to distribute the original or modified Assets internally to pastors, worship leaders, and tech directors at any of their satellite campuses for concurrent use.

3. Permitted Digital Uses

Licensee may use the Assets across all campuses in the following digital formats:

  • Live In-Person Projection: Display on projector screens, LED walls, TV monitors, and confidence monitors during live worship services, youth groups, prayer meetings, conferences, and events.
  • Digital Broadcasting & Streaming: Displaying the Assets within live video streams, simulated live broadcasts, and archived video-on-demand content hosted on platforms such as YouTube, Facebook Live, Church Online Platform, and the church’s proprietary website.
  • Digital Ministry Presentation: Utilization in sermon bumper slides, digital announcement loops, or countdown screens in a live environment or as part of a recording.

4. Allowed Alterations (Derivative Works)

Licensee is encouraged to modify the Assets visually to ensure on-screen lyric and text legibility. Permitted modifications include:

  • Cropping and resizing to fit specific screen aspect ratios (e.g., 4:3, 16:9, or ultra-wide LED formats).
  • Adjusting opacity, fading, or applying gradient masks.
  • Tweaking exposure, brightness, contrast, saturation, and color hue to match lighting aesthetics.
  • Applying creative filters, blurs, or visual overlays.
  • Layering song lyrics, Scripture verses, sermon outlines, church logos, or lower-third graphics directly over the Asset.

Note: Any modified version remains subject to the restrictions of this License and does not grant the Licensee ownership of the underlying photographic work.

5. Strict Prohibitions & Restrictions

Any use of the Assets not explicitly permitted in Sections 2, 3, and 4 is strictly prohibited. For the avoidance of doubt, Licensee agrees to the following restrictions:

  1. Absolute Prohibition of Physical Print Media. The rights granted under this License apply exclusively to digital display and electronic broadcasting. Licensee is strictly prohibited from replicating, manufacturing, or displaying the Assets (in whole or in part, modified or unmodified) on any physical, tangible medium.
    • Banned items include, but are not limited to: Church bulletins, flyers, connection cards, event postcards, brochures, banners, outdoor signage, physical stage backdrops, books, magazines, apparel (t-shirts, hats), and promotional merchandise.
    • This print ban remains strictly in effect even if the Asset has been altered, blurred, or overlayed with text, sermon titles, or church logos.
  2. No Redistribution or Sub-Licensing. Licensee shall not sell, lease, sub-license, gift, lend, or share the Assets with autonomous sister churches, external organizations, independent ministries, or individual congregants. Central media teams cannot share these files outside of their official multi-site network.
  3. No AI Training and Utilization. Licensee shall not upload, input, or feed the Assets into any generative Artificial Intelligence (AI), machine learning, or neural network models for the purpose of content generation or altering, style copying, or software training.
  4. No Standalone Web Distribution. Licensee may not upload the raw, unedited, standalone Asset files or any derivative works to public cloud drives, social media platforms, open-source websites, asset-sharing forums, or any digital location where third parties can download the files directly.
  5. Inappropriate Use. Licensee shall not use the Assets in a fashion that is reasonably considered by the Licensor to be obscene, defamatory, libelous, scandalous, or otherwise inappropriate and inconsistent with our values.

6. Ownership & Intellectual Property

Licensor retains all right, title, and interest, including copyrights, in and to the original Assets. No ownership or copyright is transferred to Licensee under this Agreement.

7. Termination

This License is effective until terminated. This License will terminate automatically and immediately without notice from Licensor if Licensee fails to comply with any of its provisions, particularly the print media or redistribution clauses. Upon termination, Licensee must immediately cease all use of the Assets and destroy all digital copies in their possession or control across all campuses. Termination of this Agreement does not relieve Licensee of responsibilities to pay any amounts due to Licensor under this agreement. Nor does it relieve Licensee of obligations to not use the Assets other than in the manner permitted under this Agreement or any other obligations that, by their nature, survive this Agreement. Licensee is not entitled to any refunds.

8. Warranties; Limitation of Liability

Licensor represents and warrants that the Assets are original works (or works for which we have all requisite permissions); are not libelous, scandalous, or unlawful; and do not infringe any copyright or other right of any person. Licensor will indemnify and hold harmless Licensee against any third-party claims with respect to a breach of these warranties. Otherwise, the Assets are provided "as is" without warranty of any kind. In no event shall Licensor be liable for any damages, including lost revenue or technical glitches during live production, arising out of the use or inability to use the Assets.

9. Miscellaneous

This Agreement (a) represents the final agreement between Licensor and Licensee with respect to its subject matter and supersedes any and all prior agreements, representations, promises, and understandings; and (b) is governed by Colorado law without regard to choice-of-law rules.

10. Amendment to These Terms

Licensor has the right to change the conditions of this Agreement from time to time, at its sole and exclusive discretion. Upon making such changes, the revised version of this Agreement will be posted on Licensor’s website, with an updated "Revised" date. Licensee is advised to check for updates regularly. In the event of material changes, Licensor may provide Licensee with notice. If Licensee does not agree to the changes to this Agreement, Licensee must cease accessing, using, and downloading any further Assets. By continuing to access, use, or download the Assets, Licensee agrees to be bound by the updated version of this Agreement, which will apply to Licensee in its entirety.
